Apple zit hier fout

Apple is een van de beste bedrijven aller tijden en heeft een reputatie opgebouwd door zelfs voor de kleinste details oog te hebben. Deze slordige, agressieve en vreemd persoonlijke rechtszaak doet die reputatie helaas geen eer aan.

Apple beweerde dat het in februari contact had opgenomen met OpenAI en dat wij niet hadden gereageerd. Apple geeft nu toe dat zijn externe advocaten de verkeerde persoon hebben gemaild nadat ze twee Aziatische achternamen hadden verwisseld, en dan nog pas nadat wij hen daarop hadden gewezen. Apple beweerde ook dat het een gesprek had gevoerd met onze juridisch directeur, maar erkent nu dat dit gesprek nooit heeft plaatsgevonden. Maar opnieuw verzwijgt Apple dat het destijds nooit de specifieke beschuldigingen uit deze rechtszaak ter sprake heeft gebracht en ons zelfs heeft gezegd dat het "eventuele problemen aan het oplossen" was. Vervolgens hoorden we vijf maanden lang niets, totdat Apple een rechtszaak aanspande. In zijn meest recente processtuk probeert Apple deze gang van zaken een andere draai te geven, maar u kunt de e-mails hier zelf lezen.

Apple beschuldigt Chang Liu ervan na zijn vertrek bij het bedrijf vertrouwelijke informatie van Apple te hebben geraadpleegd, maar geeft nu pas toe dat Apple-medewerkers contact met hem opnamen en hem vroegen te helpen die informatie te vinden (u kunt de berichten hier lezen). Apple probeert de schuld nu af te schuiven op "resterende toegang", maar verzwijgt ook dat dit een veelvoorkomend probleem bij Apple is, doordat het bedrijf de systeemtoegang bij het vertrek van medewerkers niet goed beheert. In de praktijk betekent dit dat voormalige medewerkers die bij hun vertrek het juiste proberen te doen, nog steeds toegang hebben tot bestanden van Apple, terwijl ze die toegang niet willen en zich er soms niet eens van bewust zijn.

Apple beschuldigt Tang Tan er ook van dat hij bedrijfsgeheimen van Apple probeerde te bemachtigen en te gebruiken. Tang heeft het team echter altijd duidelijk gemaakt dat we geen vertrouwelijke informatie van andere bedrijven willen hebben en die ook nooit mogen gebruiken. Tang werkte meer dan 24 jaar voor Apple en stond algemeen bekend als een van de meest innovatieve leiders binnen het bedrijf.

We hadden gewild dat Apple deze kwesties vóór het aanspannen van de rechtszaak met ons had besproken en hadden dit alles graag toegelicht. We hebben de beschuldigingen in de rechtszaak serieus genomen en aangeboden met Apple samen te werken om dit op te lossen. In plaats daarvan probeert Apple zijn verhaal bij te stellen, onder meer door vage beschuldigingen over andere voormalige medewerkers te uiten, en waarschijnlijk zal het deze tactiek blijven herhalen.

Apples verzoek om een voorlopige voorziening is gebaseerd op onjuiste informatie en bovendien volstrekt onnodig, omdat we geen van zijn bedrijfsgeheimen hebben en die ook niet willen hebben. We richten ons liever op de ontwikkeling van innovatieve producten en technologieën die grenzen verleggen.

De volgende e-mails zijn uitgewisseld tussen Apples externe advocaat Gabriel Gross, de juridisch directeur van OpenAI Che Chang en de interne juridische afdeling van Apple. Ze laten zien dat Gross Che per vergissing mailde en ten onrechte beweerde dat zij met elkaar hadden gesproken. Zowel Gross als Apples interne juridische afdeling bevestigden vervolgens dat dit een vergissing was, waarbij Gross opmerkte dat ze "eventuele problemen aan het oplossen" waren.
