Apple se equivoca

Apple es una de las mejores empresas de todos los tiempos y se labró una reputación por cuidar hasta el más mínimo detalle. Por desgracia, esta demanda descuidada, agresiva y extrañamente personal no está a la altura de esa reputación.

Apple había afirmado que se puso en contacto con OpenAI en febrero y que no respondimos. Ahora, y solo después de que se lo señaláramos, reconoce que sus abogados externos enviaron un correo electrónico a la persona equivocada tras confundir dos apellidos asiáticos. Apple también afirmó que había hablado con nuestro asesor jurídico general, algo que ahora admite que nunca ocurrió. Pero vuelve a ocultar que en aquel momento nunca planteó las acusaciones concretas de esta demanda y que, de hecho, nos dijo que estaba «resolviendo cualquier problema». Después no volvimos a tener noticias durante cinco meses, hasta que presentó la demanda. En su escrito más reciente, Apple se esfuerza por tergiversar esta sucesión de hechos, pero puedes leer los correos electrónicos aquí.

Apple acusa a Chang Liu de acceder a información confidencial de Apple después de dejar la empresa, pero solo ahora reconoce que empleados de Apple se pusieron en contacto con él y le pidieron ayuda para localizarla (puedes leer los mensajes aquí). Apple intenta ahora atribuir la culpa al «acceso residual», pero tampoco revela que este es un problema habitual en Apple, provocado por su mala gestión del acceso a los sistemas cuando alguien deja la empresa. En la práctica, esto significa que antiguos empleados que intentan hacer lo correcto al marcharse siguen teniendo acceso a archivos de Apple, aunque no lo quieran ni sepan siquiera que lo tienen.

Apple también acusa a Tang Tan de intentar obtener y utilizar sus secretos comerciales. Sin embargo, Tang siempre ha dejado claro al equipo que no queremos ni debemos utilizar información confidencial de otras empresas. Tang trabajó para Apple durante más de 24 años y era ampliamente reconocido como uno de los líderes más innovadores de la empresa.

Nos habría gustado que Apple nos planteara estas cuestiones antes de presentar la demanda y habríamos estado encantados de aclarárselo todo. Nos hemos tomado en serio las acusaciones de la demanda y nos hemos ofrecido a colaborar con Apple para resolver la situación. En lugar de eso, intenta cambiar su relato, incluso mediante acusaciones vagas contra otros antiguos empleados, y probablemente seguirá repitiendo esta táctica.

La solicitud de Apple de una medida cautelar preliminar se basa en información falsa y es totalmente innecesaria, porque no tenemos ni queremos ninguno de sus secretos comerciales. Nos interesa mucho más crear productos y tecnologías innovadores que amplíen los límites de lo posible.
