Apple to jedna z najwybitniejszych firm wszech czasów, która zbudowała swoją reputację na obsesyjnej dbałości o najdrobniejsze szczegóły. Niestety ten niedbały, agresywny i zaskakująco osobisty pozew nie dorasta do tej reputacji.

Apple twierdziło, że skontaktowało się z OpenAI w lutym, a my nie odpowiedzieliśmy. Teraz Apple przyznaje, że jego zewnętrzni prawnicy pomylili dwa azjatyckie nazwiska i wysłali e-mail do niewłaściwej osoby — ale dopiero po tym, jak zwróciliśmy na to uwagę. Apple twierdziło również, że odbyło rozmowę z naszym głównym radcą prawnym, choć teraz przyznaje, że do niej nie doszło. Nadal jednak przemilcza fakt, że nie przedstawiło wówczas konkretnych zarzutów zawartych w pozwie, a wręcz poinformowało nas, że „wyjaśnia wszelkie kwestie”. Potem przez pięć miesięcy nie otrzymaliśmy żadnej wiadomości — aż do wniesienia pozwu. W swoim najnowszym piśmie Apple usilnie próbuje przedstawić ten przebieg wydarzeń w korzystnym dla siebie świetle, ale e-maile można przeczytać samodzielnie tutaj.

Apple oskarża Changa Liu o uzyskanie dostępu do poufnych informacji Apple po odejściu z firmy, lecz dopiero teraz przyznaje, że to pracownicy Apple skontaktowali się z nim i poprosili o pomoc w odnalezieniu tych informacji (wiadomości można przeczytać tutaj). Apple próbuje teraz zrzucić winę na „dostęp zachowany po odejściu”, ale nie ujawnia, że jest to w tej firmie częsty problem, wynikający z niewłaściwego zarządzania dostępem do systemów po odejściu pracowników. W praktyce oznacza to, że byli pracownicy, którzy odchodząc, starają się postąpić właściwie, nadal mają dostęp do plików Apple — choć tego nie chcą, a nawet mogą nie być tego świadomi.

Apple oskarża również Tanga Tana o próbę pozyskania i wykorzystania jego tajemnic handlowych. Tang od początku jasno informował jednak zespół, że nie chcemy i nie możemy wykorzystywać żadnych poufnych informacji innych firm. Tang pracował dla Apple przez ponad 24 lata i powszechnie uchodził za jednego z najbardziej innowacyjnych liderów w firmie.

Wolelibyśmy, aby Apple poruszyło z nami te kwestie przed wniesieniem pozwu — chętnie wyjaśnilibyśmy wszystkie okoliczności. Poważnie potraktowaliśmy zarzuty zawarte w pozwie i zaproponowaliśmy Apple współpracę w celu rozwiązania tej sprawy. Zamiast tego Apple próbuje zmienić swoją narrację, między innymi wysuwając niejasne oskarżenia wobec innych byłych pracowników, i zapewne nadal będzie stosować tę taktykę.

Wniosek Apple o wydanie nakazu tymczasowego opiera się na nieprawdziwych informacjach i jest całkowicie zbędny, ponieważ nie posiadamy ani nie chcemy posiadać żadnych tajemnic handlowych tej firmy. Znacznie bardziej interesuje nas tworzenie innowacyjnych produktów i technologii, które przesuwają granice możliwości.
